“The Hardin Congregation hereby files this brief in opposition to the Plaintiffs’ Motion To Compel Re: The Hardin Congregations Subpoena. The Hardin Congregation is a non-party to this litigation. As such, it is seeking to intervene pursuant to Rule 24(b), F.R.Civ.P. to for the limited and exclusive purpose of responding to the plaintiffs’ motion as it has a vested interest in the resolution of the issues raised by plaintiffs.”

 

“Conclusion.
Pursuant to applicable Montana case law on point, this Court must preserve the sanctity of the Jehovah’s Witnesses right to maintain all of the communications at issue in strict confidence in accordance with church doctrine, canon and established practice. Plaintiffs’ Motion To Compel must therefore be DENIED its entirety.”
